Unsolicited Advertisements - Baltimore County Code Guidance  !new!

FYI...Here are the Baltimore County Code and guidance about unsolicited advertisement flyers. If this code is violated, Code Enforcement (CE) requires the actual recipient (homeowner) to make the complaint and testify, if needed, should it proceed to a hearing. CE’s phone number is 410-887-3351. While we have signs posted in our community about “no solicitation”, they are a deterrent for this activity, but we must follow the code below.

Per the code one can place flyers once every 6 months therefore twice a year. We require the actual recipient (homeowner) to make the complaint and testify, if needed, should it proceed to an ALJ hearing. In practice, we go to the business and talk to the owner about the code and cease the activity. Should it continue than we will issue a notice and if warranted go to a hearing.

§ 21-19-101. DEFINITIONS.
(a) Definitions. In this title, the following words have the meanings indicated.

(b) Unsolicited advertising circular. Unsolicited advertising circular means any printed or written circular, notice, or other item the predominate purpose of which is:

(1) To advertise one or more products, services, or other things for sale, lease, or trade;

(2) To direct attention to one or more businesses, commodities, services, events, or other activities for which a fee is charged or solicited; or

(3) Otherwise to promote activity of a business or commercial nature.

(c) Deliver. Deliver means to throw, place, or deposit. The term does not include delivery by means of the United States Postal Service or a private mail delivery service.

(d) Director. Director means the Director of the Department of Permits, Approvals and Inspections or the Directors designee.

(e) Publisher. Publisher means the person responsible for the publication of an unsolicited advertising circular.

§ 21-19-102. SCOPE.
This title applies to a publisher that delivers more than one unsolicited advertising circular to a residential address in the county within any six-month period.

§ 21-19-103. DELIVERY PROHIBITED.
(a) Notice regarding non-delivery. A publisher may not deliver, or cause to be delivered, an unsolicited advertising circular to a residential address in the county (whether delivered in or on a fence, railing, door, porch, lawn, sidewalk or otherwise) unless the circular contains a conspicuous notice, printed in at least 12 point boldface type, that includes:

(1) The statement If you no longer wish to receive this publication, please call the following number:; and

(2) A toll-free or local telephone number that a resident may call to notify the publisher that the resident no longer wishes to receive the unsolicited advertising circular.

(b) Delivery prohibited upon notification. A publisher may not deliver, or cause to be delivered, an unsolicited advertising circular to a residential address in the county after 7 days from the date the publisher received notice from the resident that the resident does not wish to receive the unsolicited circular.

Editors note:
Section 2 of Bill No. 64-09 provides that a person subject to the requirements of Article 21, Title 19 of the Baltimore County Code, 2003 shall comply with the requirements of Article 21, Title 19 by no later than January 1, 2010.

§ 21-19-104. PENALTY.
(a) General. A person who violates any provision of this title is subject to a civil penalty.

(b) Amount. The amount of the penalty may not exceed:

(1) $500 for the first offense; and

(2) $1,000 for each additional offense.

§ 21-19-105. ENFORCEMENT.
(a) Enforcement by Director.

(1) The Director shall enforce the provisions of this title in accordance with Article 3, Title 6 of the Code.

(2) The Director may adopt regulations, in accordance with Article 3, Title 7 of the Code, to carry out the provisions of this title.

(b) Issuance of citation. The Director may issue a citation alleging a violation of this title to the publisher or to the person who delivers an unsolicited advertising circular.

County Executive Kevin Kamenetz announced today (Aug. 30, 2011) that dumpsters will be placed at a number of career fire stations in an effort to assist residents with the disposal of yard waste caused by storm damage. The dumpsters will be placed at these stations beginning Monday, September 5: Towson, Woodlawn, Halethorpe, Dundalk, Essex, Fullerton, Edgemere, Hillendale, Middle River, Westview, Brooklandville, Eastview, Texas, Randallstown, Garrison, Chase, Perry Hall, Franklin and Parkton. Addresses for all fire stations are available online. THESE DUMPSTERS WILL ACCEPT YARD WASTE ONLY. 
Residents should continue to bundle or bag yard waste and set it out at the curb on their regular recycling days. The dumpsters are intended as an extra resource.

Downed Trees 

According to BGE, a list of streets are closed due to downed trees or branches that involve power lines. BGE must address these issues because of the power lines involved. They have told us they are waiting on tree companies and available BGE workforce to remedy these situations. Baltimore County's Bureau of Highways is responsible for clearing County roads. Kamenetz Urges Public to Follow Emergency Updates During Hurricane - Urges Citizens to be Prepared

Towson, MD (August 25, 2011) - Baltimore County Executive Kevin Kamenetz is
urging County residents to be prepared to access the most current information regarding the possible arrival of Hurricane Irene this weekend.  During emergency events, Baltimore County officials post regular updates on Twitter @ BACOemergency. Those updates are also posted on the Baltimore County website at

 and click on the tile that will read "Emergency Updates." That tile is posted only during emergency events.

County officials are also encouraging citizens to make careful preparations in anticipation of the possible storm with the right supplies:

-- A battery-powered radio with extra batteries. If the power goes out, a battery-powered radio is the only way to receive information.

    -- Flashlights or battery-powered lanterns with extra batteries. Don't use candles! They start fires.
    -- Water to last three days. That's at least one gallon per person per day for drinking and sanitation.

Task Force to Study Changes to Restaurant Liquor License
Law to Boost Economic Development 

Towson, MD (August 4, 2011) - Baltimore County Executive Kevin Kamenetz announced the formation of a task force to examine changes to Baltimore County's liquor license laws to encourage economic development for restaurants in Baltimore County. The task force will be co-chaired by the County's Executive Director of Economic Development, Dan Gundersen and its Chief Administrator for the Liquor Board, Mike Mohler. The County Executive is asking the task force to take a comprehensive look at how licenses are distributed in Baltimore County and around the State. The group will prepare a report for the Executive's review by November 15, 2011. "I want to make it clear that this review should focus on licenses for restaurants only. There is no need to look at the expansion of bar or
package goods stores. I am only interested in having this group take a look at the need for liquor licenses to support the expansion of the restaurant sector of Baltimore County's economy," said Kamenetz.
